Important Limitations

What We Can and Cannot Guarantee

✅ What We WILL Do:

  • Remove content promptly upon valid takedown request
  • Take reasonable steps to prevent re-posting by the same user
  • Keep records of removed content and repeat offenders
  • Respond to all properly submitted requests

❌ What We CANNOT Guarantee:

  • That other users will not re-upload the same or similar content
  • Prevention of all future uploads of similar content
  • Monitoring or proactive detection of infringing content
  • Legal action against users who posted infringing content
  • Compensation for any damages resulting from the infringement

Re-Upload and Repeat Infringement Policy

If the same or substantially similar infringing content is re-uploaded by users (whether the original uploader or different users):

  • You must submit a new takedown request each time via email to support@matecode.com.au
  • Reference previous takedown request numbers (if available) to expedite processing
  • We will remove the content again, but cannot prevent future re-uploads by other users
  • Repeat offenders (identified users) may have their accounts suspended or banned
  • We do NOT automatically monitor or filter for previously removed content

💡 Understanding the Platform Nature

MateCode is a user-generated content platform. While we promptly respond to takedown requests, we cannot guarantee that content won't be re-posted by the broader community. Each new instance requires a new takedown notice. This is standard practice for platforms hosting user-generated content.

Counter-Notifications

If you believe your content was wrongly removed, you may submit a counter-notification to support@matecode.com.au with:

  • Your contact information and signature
  • Identification of the removed content
  • Statement under penalty of perjury that the content was removed by mistake
  • Consent to jurisdiction of Australian courts

We will forward your counter-notification to the original complainant. If they do not initiate legal action within 10-14 business days, we may restore the content.

Repeat Infringer Policy

MateCode will terminate accounts of users who are determined to be repeat infringers. We maintain records of all takedown requests and will take action against users with multiple substantiated claims.

False Claims and Misrepresentation

⚖️ Legal Consequences

Submitting a false or fraudulent DMCA takedown notice is illegal and may result in:

  • Civil liability for damages under Australian law
  • Potential criminal penalties for perjury
  • Liability for attorney's fees and court costs
  • Being banned from submitting future requests to MateCode

Limitation of Liability

MateCode acts as an intermediary platform for user-generated content. By submitting a takedown request, you acknowledge that:

  • We are not liable for user-posted infringing content
  • We are not responsible for monitoring or detecting infringements proactively
  • Our removal of content does not prevent re-uploads by other users
  • We do not guarantee complete removal of all similar content
  • We are not liable for any damages you suffered from the original infringement
  • Enforcement against individual infringers is your responsibility
